The United States Federal Bureau of Investigation (FBI) has approached the U.S. District Court for the District of Columbia seeking permission to submit classified justifications under seal regarding historical records tied to Nigerian President Bola Tinubu.
In a motion filed before Judge Beryl Howell, the bureau requested to present its detailed reasoning ex parte and in camera—privately to the judge without adding the materials to the public docket. The agency contends that a public disclosure of its justifications would inadvertently compromise the very sensitive information it aims to protect, including law enforcement techniques and individual safety.
The legal tussle stems from a Freedom of Information Act (FOIA) lawsuit filed by transparency activist Aaron Greenspan, founder of PlainSite. Greenspan is seeking government files and FBI Form 302 interview reports from a 1990s Chicago-based investigation involving historical financial and legal inquiries.
While the FBI has applied several FOIA exemptions—citing personal privacy, confidential sources, and investigative procedures—Greenspan has challenged the wholesale withholding of the dossiers. The ongoing proceedings continue to draw intense public scrutiny as legal teams navigate the boundaries of public transparency and state secrecy.
