A Manhattan federal court has handed down an 18-month prison sentence to 54-year-old North Carolina musician Michael Smith, marking a landmark legal reckoning in the intersection of artificial intelligence and digital music crime.
The Scheme: Automated Accounts and AI Tracks
Between 2017 and 2024, Smith engineered a sophisticated streaming fraud operation using automated bot software. Rather than relying on human listeners, he deployed up to 10,000 bot accounts simultaneously to continuously loop tracks across major platforms, including Spotify, Apple Music, Amazon Music, and YouTube Music.
To evade detection by platform anti-fraud algorithms, Smith utilized artificial intelligence tools to flood the digital space with hundreds of thousands of low-effort, AI-generated songs. By dispersing billions of artificial streams across a massive catalog, his setup made suspicious listening spikes look like organic traffic. At its peak, the scale of the operation triggered staggering anomalies—such as generating 80.9 million streams on YouTube Music family plans in a single month, vastly outpacing major global acts like Taylor Swift within the same specific subscription bracket.
Impact on the Music Industry
Prosecutors emphasized that the scheme siphoned more than $8 million in royalties from shared industry pools, directly undercutting hardworking artists and legitimate rights holders who rely on genuine audience engagement. Because digital royalty payouts are distributed proportionally based on total streaming shares, the artificial inflation artificially diluted earnings for human creators.
The case has triggered broader regulatory panic, prompting agencies like the U.S. Copyright Office to launch formal inquiries into streaming manipulation, digital safeguards, and the unchecked monetization of AI-generated media.
Sentencing and Fallout
While federal prosecutors pushed for a 46-month custodial sentence, and defense attorneys pleaded for probation, U.S. District Judge John G. Koeltl ultimately settled on 18 months behind bars, followed by two years of supervised release.
During Tuesday’s sentencing hearing, a visibly emotional Smith—who is a father of six—broke down and confessed to abandoning his integrity.
”By committing this crime, I have failed miserably,” Smith told the court.
Alongside his prison term, Smith was ordered to execute a full financial forfeiture of $8,091,843.64 to strip away the illicit proceeds of his automated enterprise.
