
WASHINGTON — The Trump administration has escalated its legal battle over military personnel standards, petitioning the Supreme Court to permit the immediate discharge of active-duty transgender service members.
In an emergency appeal filed by U.S. Solicitor General D. John Sauer, the administration asked the justices to set aside a lower-court injunction that has temporarily shielded a group of about two dozen service members from being forced out. The filing challenges a June ruling from the U.S. Court of Appeals for the District of Columbia Circuit, which found that the Pentagon’s exclusion policy likely violated constitutional equal protection principles and appeared rooted in animus rather than military necessity.
At the center of the dispute is an executive order signed by President Trump shortly after taking office, directing the Department of Defense to exclude individuals with gender dysphoria from the armed forces. Administration officials argue that standard deployment constraints, medical requirements, and unit cohesion priorities give the executive branch broad, deferential authority to manage military qualifications.
Defense data indicates that roughly 4,240 personnel across active-duty, reserve, and National Guard ranks carry a diagnosis of gender dysphoria. While the administration’s broader policy on new enlistments has largely faced fewer judicial roadblocks, lower courts have fractured over whether the government can truncate the careers of seasoned personnel currently in uniform.
Lawyers representing the service members counter that rushing to separate decorated, proven troops before a full trial causes irreversible damage. The Supreme Court is expected to review the emergency application and decide this fall whether to formally grant certiorari for its upcoming term.
