A Federal High Court in Abuja has dismissed a suit filed by former Kaduna State Governor Nasir El-Rufai seeking to prevent anti-corruption agencies and other government institutions from freezing his bank accounts or seizing his assets.

Justice Joyce Abdulmalik dismissed the suit on Thursday, October 8, 2026, after agreeing with the respondents that the case constituted an abuse of court process, according to published reports, ValidViewNetwork reports.

El-Rufai had sued the Independent Corrupt Practices and Other Related Offences Commission, the Economic and Financial Crimes Commission, the Department of State Services and the Attorney-General of the Federation.

The court reportedly accepted the argument that El-Rufai had instituted similar proceedings before the Federal Capital Territory High Court and the Federal High Court.

COURT FOCUSES ON THE MULTIPLE PROCEEDINGS

The central issue in the reported ruling was not simply whether investigators should be permitted to freeze accounts or seize assets.

It was whether El-Rufai could pursue similar relief through multiple court proceedings.Courts must guard against the misuse of judicial processes, including attempts to pursue substantially similar claims in different proceedings where doing so undermines the proper administration of justice.

The dismissal therefore represents a legal setback for the former governor in his attempt to secure the requested restraint. It should not, however, be misrepresented as a finding that every allegation against him has been proved.

A court’s dismissal of a suit on procedural grounds is distinct from a determination of criminal guilt.

THE ROLE OF ANTI-CORRUPTION AGENCIES

The ICPC and EFCC have statutory responsibilities to investigate suspected corruption and financial crimes within their respective mandates.

Freezing accounts or restraining the disposal of assets may be necessary in particular investigations, but such measures must comply with the law and applicable judicial safeguards.

The existence of an investigation does not automatically establish wrongdoing. Equally, a public official’s former position does not exempt that individual from a lawful investigation.

The same principles must apply regardless of political affiliation.

WHY THE RULING MATTERS

The case highlights the importance of allowing investigations and legal challenges to proceed through established judicial procedures.

Public officials and former officeholders retain the right to challenge actions they believe are unlawful. Investigative agencies, in turn, must justify coercive measures through lawful procedures and credible evidence.

The judiciary must protect both interests without allowing court processes to become instruments for obstruction or political persecution.
