South African Opposition Leader Julius Malema Sentenced to 5 Years Over 2018 Rifle Incident

KUGOMPO CITY – In a landmark ruling that could reshape the South African political landscape, a Magistrate’s Court in KuGompo City (formerly East London) has sentenced the leader of the Economic Freedom Fighters (EFF), Julius Malema, to five years of direct imprisonment.

​The sentencing, handed down on Thursday, follows Malema’s conviction on multiple counts, including the unlawful possession of a firearm and ammunition, as well as the reckless endangerment of lives. The charges stem from a 2018 incident during the EFF’s fifth-anniversary celebrations at the Sisa Dukashe Stadium in Mdantsane, where Malema was captured on video discharging an assault rifle into the air.

​”Not an Impulsive Act”

​Delivering the judgment, Magistrate Twanet Olivier dismissed the defense’s argument that the shots were merely “celebratory” or that the weapon used was a toy firing blanks.

​“Such behavior cannot be tolerated by the court… to further justify the commission of an offense as celebratory shots,” Olivier stated, noting that the act was a deliberate violation of firearm laws in a public space. The court emphasized that as a high-profile lawmaker, Malema’s actions set a dangerous precedent for his millions of followers.

​Political and Legal Implications

​The five-year sentence carries significant weight beyond the jail time. Under South African law, any citizen sentenced to more than 12 months in prison without the option of a fine is disqualified from serving as a Member of Parliament. If the sentence is upheld, it would effectively end Malema’s current tenure in the National Assembly and bar him from future elections for a specified period.

​While the prosecution had pushed for a 15-year term, lead prosecutor Joel Ceasar welcomed the ruling, stating it reinforces the principle that no one is above the law.

​Immediate Appeal

​The EFF leadership and Malema’s legal team have consistently maintained that the case is a “politically motivated” witch-hunt orchestrated by the lobby group AfriForum.

​Immediately following the pronouncement, Malema’s lawyers filed for leave to appeal both the conviction and the sentence. The court is currently considering the application, which may allow Malema to remain out on bail pending the exhaustion of all legal avenues.

​Outside the courthouse, hundreds of EFF supporters dressed in their trademark red berets gathered to protest the decision, vowing to stand by their leader as the legal battle moves to the High Court.
