The suspended Dean of the Faculty of Law at the University of Calabar, Cyril Ndifon, has stated that he had a consensual relationship with a diploma graduate, referred to as TKJ (name withheld based on the court’s order), whom he was accused of sexually harassing.
Ndifon is currently facing trial on amended four counts of alleged sexual harassment and gratification charges filed against him by the Independent Corrupt Practices and Other Related Offences Commission (ICPC).
His lawyer, Sunny Anyanwu, has also been implicated in the matter for allegedly harassing TKJ and advising her to ignore the ICPC’s summons.
TKJ, who is the star witness for the ICPC, testified that Ndifon had demanded her virginity and coerced her into performing oral sex in exchange for admission into the LLB program at the university.

However, in a copy of the no-case submission filed by Ndifon’s lawyer, Joe Agi (SAN), it was argued that the evidence suggests a consensual relationship between Ndifon and TKJ.
The submission pointed to text messages exchanged between them that conveyed love, affection, and mutual concern for each other’s safety.
Ndifon further claimed that the ICPC violated his fundamental human rights by seizing his phones without a court order.
He argued that the commission unlawfully accessed his phone and initiated investigations, including into the alleged offense of cyberstalking, based on nude and pornographic pictures found therein.
He urged the court to decline jurisdiction over the case, highlighting inconsistencies in the prosecution’s claims and procedures.

Ndifon contended that certain charges brought against him, particularly those related to cybercrimes and sending/receiving nude videos, fall outside the court’s jurisdiction as per relevant statutes.
The adoption of written addresses on the no-case submission is scheduled for February 27, 2024.
