An 82-year-old Democratic state senator in Virginia, L. Louise Lucas, has been indicted alongside six others, including members of her family, over an alleged racketeering conspiracy involving the illegal sale of marijuana and money laundering.
The indictment, unsealed on Thursday, alleges that Lucas and her co-conspirators ran a criminal enterprise that purchased and sold illegal amounts of marijuana in the state to build her family’s wealth .
THE ALLEGATIONS
According to the indictment, Lucas, the president pro tempore of Virginia’s Senate and a long-time advocate for marijuana legalization, used her position as Chairwoman of the Senate Finance and Appropriations Committee to insulate the enterprise from criminal scrutiny and to influence legislation for financial benefit.
FBI Director Kash Patel alleged that Lucas and “a close-knit group of family members and associates” orchestrated a multi-year scheme to enrich their “criminal marijuana enterprise”.
The Justice Department alleged that Lucas “failed to report the interest obtained in this entity on her required Statement of Economic Interests forms” as a legislator.
It also alleged that she received a “bribery payment” from a co-conspirator in connection with a recreational marijuana license .Investigators quoted Lucas telling an unidentified co-conspirator in a February phone call:
“This is our last chance at generational wealth. I’ve got too old to not be greedy”.
LUCAS’S RESPONSE
Lucas has denied wrongdoing and characterized the indictment as a political attack.
“Today, the FBI, the Department of Justice, and the full weight of the federal government have been wielded against an 82-year-old great-grandmother,” she said in a statement.
“I grew up under Jim Crow. I’ve seen what happens when people in power try to silence those who stand up to them. I spent my life fighting back, and I’m not stopping now”.
THE POLITICAL FALLOUT
Virginia Democratic Governor Abigail Spanberger questioned the timing of the indictment, which comes weeks before Election Day.
“The timing of this indictment undermines the U.S. Department of Justice’s previously longstanding policy of not taking legal actions, to include indictments or significant investigative steps — close to an election,” Spanberger said.
Lucas, who has served in the state Senate since 1992, is not up for reelection this year. However, her daughter, Lisa Lucas-Burke, who was also charged, is currently running for City Council in Portsmouth, Virginia.
WHY IT MATTERS
The indictment of an 82-year-old state senator is a significant moment in Virginia politics.
Lucas is one of the most powerful Democrats in the state, and her indictment raises questions about the intersection of politics, business and marijuana regulation.
The timing of the charges, just weeks before the election, has also fueled accusations of political interference.
