TENNESSEE’S FIRST FEMALE EXECUTION IN 200 YEARS ENDS WITH PIKE STILL ALIVE

THE EXECUTION THAT DID NOT END IN DEATH

Christa Gail Pike, the Tennessee death-row prisoner scheduled to become the first woman executed by the state in more than 200 years, survived an attempt to put her to death by lethal injection after officials administered two doses of pentobarbital.

Pike, 50, remained alive and was reportedly still snoring after the second dose, according to her lawyers and execution witnesses.

She was eventually taken by ambulance to an off-site medical facility.

The Tennessee Department of Correction confirmed that Pike was transported for medical treatment but said officials followed the state’s established execution protocol.

“The Tennessee Department of Correction followed every step of the State’s lawful, established execution protocol approved by the Attorney General’s Office,” the department said.

It added that the lethal-injection chemical used in the protocol had consistently been effective and that the protocol did not permit additional procedures beyond those carried out that night.

The execution had begun after a dramatic legal battle.

A federal appeals court had temporarily stopped the execution earlier on Wednesday while considering claims raised by Pike’s lawyers.

The US Supreme Court later lifted the stay, allowing Tennessee to proceed.

Pike’s lawyers subsequently filed emergency applications seeking to halt the execution and arguing that the failed procedure subjected their client to unnecessary suffering and violated the constitutional prohibition against cruel and unusual punishment.

THE 1995 MURDER THAT PUT PIKE ON DEATH ROW

Pike was 18 when she was convicted in the 1995 murder of 19-year-old Colleen Slemmer, a fellow student at the Knoxville Job Corps.

Prosecutors said Pike regarded Slemmer as a romantic rival and lured her with her boyfriend, Tadaryl Shipp, to an isolated location.

The killing became notorious because of its brutality and because a satanic symbol was carved into Slemmer’s body.

Pike was convicted of premeditated first-degree murder and conspiracy and sentenced to death in 1996. Pike has not disputed her responsibility for the killing.

Her lawyers have instead argued that the death sentence should be reconsidered because of her age at the time of the crime, severe childhood abuse and neglect and mental-health issues.

Her lawyers argued that contemporary understanding of adolescent brain development and trauma should be considered in determining whether execution remains constitutionally permissible.

The US Supreme Court, however, declined her application for a stay on September 29, 2026. The Court’s docket records show that the application and petition for certiorari were denied.

ALABAMA HAD A SIMILAR QUESTION AFTER KENNETH SMITH SURVIVED

Pike’s failed execution raises an important question that has already confronted Alabama courts: what happens when a state attempts an execution but fails to complete it?

Kenneth Eugene Smith provides one of the clearest recent examples.

Alabama attempted to execute Smith by lethal injection in November 2022. Officials spent hours attempting to establish the required intravenous lines but eventually abandoned the execution.

Rather than ending Smith’s death sentence, Alabama sought authority to attempt another execution using a different method, nitrogen hypoxia.

The Alabama Supreme Court ultimately allowed the state to proceed with a second execution attempt, rejecting Smith’s argument that another attempt would violate constitutional protections against cruel and unusual punishment.

Alabama subsequently executed Smith by nitrogen hypoxia in January 2024, making him the first person in the United States executed using that method.

But another Alabama case followed a different path.

Doyle Lee Hamm survived an attempted lethal injection in 2018 after execution personnel spent about two and a half hours trying unsuccessfully to establish an intravenous line.

The execution was abandoned, and Alabama later reached a confidential settlement with Hamm that prevented another execution attempt. Hamm eventually died of cancer on death row in 2021.

Those cases do not automatically determine what will happen to Pike, but they show that a failed execution does not by itself produce one automatic legal outcome.

TENNESSEE HAS ALREADY HAD ANOTHER FAILED EXECUTION THIS YEAR

Pike’s case is also the second Tennessee execution failure in 2026.

In May, officials halted the scheduled lethal injection of Tony Carruthers after execution personnel spent more than an hour trying unsuccessfully to establish an intravenous line.

That earlier failure had already generated calls for a review of Tennessee’s execution procedures.

After Pike’s failed execution, Governor Bill Lee announced that the remaining execution scheduled for 2026 would not proceed and ordered a comprehensive independent review to determine exactly what happened.

The governor said executions must be conducted in a manner that is legal, constitutional and effective.

WHAT COULD HAPPEN TO PIKE NOW?

The failed execution does not automatically erase Pike’s death sentence.

Her lawyers are likely to continue challenging the legality and constitutionality of the execution attempt, while the state review could examine the drugs used, the execution protocol, the medical process and the decisions made inside the death chamber.

The Alabama cases demonstrate two possible legal directions: a state may seek authority for another execution attempt, as happened with Kenneth Smith, or litigation may ultimately result in an agreement preventing another attempt, as happened with Doyle Hamm.

Pike’s case also contains an additional legal complication because her lawyers had been challenging how her childhood abuse and mental-health history were considered.

A Tennessee Supreme Court special master had examined those claims before the state’s highest court rejected them in September. The US Supreme Court subsequently denied Pike’s application for a stay.

For now, the immediate development is the independent review ordered by Governor Lee and the emergency litigation initiated by Pike’s lawyers.“

The Pike case now moves into an unusual legal phase in which the courts may have to determine what constitutional and procedural consequences flow from an execution that was authorised, commenced and involved two lethal doses, but did not result in death.
