About 700 eligible offenders will leave jails in England and Wales on the morning of October 1, 2026, under the UK government’s revised early prison release plan, which excludes rape, grooming, and child sex offences while aiming to ease overcrowding in prisons running at 97 per cent capacity.

A Controversial Plan to Ease Prison Overcrowding

About 700 eligible offenders will walk out of prisons in England and Wales on the morning of October 1, 2026, under the UK government’s revised early release scheme, with approximately 2,550 prisoners projected to have been released by the end of the year.

The plan, signed into law and published online, keeps the original schedule of releases but delays the start date by a month and excludes specific offences from the programme.

Prime Minister Andy Burnham, addressing the House of Commons, said he understood the “anguish” of victims and had listened to their concerns.

“I came in and asked for changes to the early release scheme, and we excluded rape, grooming, and child sex offences,” Burnham said.

How the Releases Will Work

Under the original plan, offenders serving sentences of up to 19 months would have been eligible from September 2 to walk out of jail after serving a third of their sentence.

That start date has now been moved to October 1. From October 13, governors will release a second tranche of 650 prisoners who have been serving sentences of between 19 months and two years and five months.

Prisons in England and Wales are currently running at 97 per cent capacity, with the latest Ministry of Justice figures showing the number of available spaces across the male prison estate at its lowest this year, about 1,500 free spaces.

A Phased Release

The rest of the estimated releases will be phased in over the coming months:

· November 10: 650 offenders serving up to three years and two months

· December 8: 550 offenders serving up to four years and three months

· January 12, 2027: 600 offenders serving up to five years and nine months

· February 9: 500 offenders serving up to seven years and six months

· March 9: 200 offenders serving up to nine years

· April 13: 200 offenders serving up to 10 years

· May 11: 250 offenders serving up to 12 years

· June 9: 250 offenders serving more than 12 years

The offenders serving longer sentences, which do not become part of the scheme until next year, include more dangerous criminals who would have previously expected to spend two-thirds of their sentence behind bars.

Under the new rules, this group will instead leave jail at the halfway point.

Crimes Excluded from the Scheme

The ministerial order lists 71 crimes that are exempt from the earlier release scheme, including manslaughter, rape, and sexual and grooming offences.

Prisoners on special extended sentences and those on life terms are also excluded.

New Cells from Old Spaces

To tackle overcrowding, the government is creating more cells in existing prisons.

An investment of £110 million, which is set to come from existing budgets, will be used to convert unused office space, laundry rooms, and storage spaces into cells.

Justice Secretary Alex Norris told the BBC that being released did not mean “freedom” and that victims would have a say in restrictions placed on released criminals.

A Lesson for Nigerian Youths

This story is a reminder that crime has consequences, but so does overcrowding.

The UK government is forced to release prisoners early because the system cannot cope.

This is not a sign of leniency; it is a sign of failure.

For Nigerian youths, the lesson is clear: crime does not pay, but the system that punishes crime is also imperfect.

Instead of waiting for the system to fail, young people should focus on building legitimate lives.
