Lawyer Sues FG, NCAA, Ibom Air, and Others for N500bn Over Aviation Impunity

LAGOS — In a dramatic legal move, public interest lawyer Ayodele Ademiluyi has filed a landmark N500 billion lawsuit at the Federal High Court in Lagos against the Federal Government, the Nigerian Civil Aviation Authority (NCAA), Ibom Air, and a host of others, citing “blatant breaches of the rule of law” in the handling of two controversial aviation infractions involving renowned musician King Wasiu Ayinde Marshal (popularly known as KWAM 1) and passenger Ms. Comfort Emmanson.

The suit, numbered FHC/L/CS/1632/25, names major Nigerian aviation officials and institutions among the respondents, including President Bola Tinubu, the Attorney-General of the Federation, Minister of Aviation Festus Keyamo (SAN), FAAN, ValueJet, Nigerian Correctional Service, the Nigerian Police, the Governor and Attorney-General of Akwa Ibom State, and the Airline Operators of Nigeria.

At a press conference on Friday, Ademiluyi described the case as a public interest action aimed at enforcing accountability and defending the rule of law. He accused aviation authorities of gross imbalance in their response to the cases, highlighting that KWAM 1—who allegedly blocked a ValueJet plane from taxiing at Abuja Airport during a confrontation over carrying excess liquid—was not arrested or prosecuted and was instead named an ambassador for airport security. Meanwhile, Emmanson, a female passenger on Ibom Air, faced swift arrest, detention, and an initial lifetime ban (later withdrawn) for alleged unruly conduct on a separate flight.

“Our aviation system needs a complete overhaul. We can’t allow impunity to reign or let Nigeria degenerate into a banana republic where someone can stop a plane and walk away without consequence,” Ademiluyi declared. “It’s a gross imbalance. No arrest, no arraignment, no prosecution of KWAM 1. In fact, he got rewarded with an ambassadorship—a terrible message to the public.”

The lawyer emphasized that the issue goes far beyond the individuals involved and reflects systemic decay within Nigeria’s aviation sector. He also criticized Minister Keyamo for allegedly speaking in defense of one of the airlines involved, instead of enforcing the law impartially.

Ademiluyi is requesting an order of mandamus to compel the relevant authorities—particularly the Nigerian government and aviation sector—“to take proper action, especially against Mr. KWAM 1,” stressing that the sanctity of the rule of law is at stake and that nobody should be above the law, regardless of influence or celebrity status.

The lawsuit comes after widespread public debate and regulatory intervention sparked by KWAM 1’s airport conduct and the disparate legal consequences meted out to Emmanson, raising broader concerns about favoritism, effective enforcement, and equal treatment under Nigerian aviation law.

With this suit, Ademiluyi is urging Nigeria’s judicial system to reaffirm that neither celebrity nor position should trump the fundamental rule of law, as global attention turns to how the nation’s aviation authorities will respond and whether a new precedent will emerge.
