
In a notable divorce case heard at a Sharia Court in Rigasa, Kaduna, Mrs. Zainab Alhassan ended her marriage to Mr. Tijjani Muhammad following his refusal to repair her damaged Android smartphone valued at ₦70,000. The court granted her request for dissolution of the marriage through the Islamic Khul’i process, which permits a wife to initiate divorce by returning her dowry.
Zainab told the court that the marriage had irretrievably broken down, citing her husband’s neglect and disregard for her welfare exemplified by his refusal to fix the phone. She recounted that during a domestic dispute, her husband allegedly smashed her phone while she was watching a movie on it, and despite her repeated pleas for repair, he showed no concern. She stated this amounted to emotional neglect affecting her well-being.
The respondent denied damaging the phone but did not oppose the divorce proceedings. The presiding judge, Malam Mu’awiyya Shehu, ruled in favor of Zainab, declaring that reconciliation was no longer possible, and thus approved the dissolution of the marriage. However, the court dismissed Zainab’s request for the phone to be repaired or compensated.
The case has triggered diverse opinions on social media, with some debating the seeming triviality of the reason cited for divorce, while others underscored that refusal to attend to a spouse’s needs may indicate deeper issues of care and respect within a marriage. Legal experts note that under Islamic law, Khul’i divorce is a legitimate remedy for wives facing persistent neglect or harm without reconciliation.
This incident sheds light on the broader societal expectations of mutual care in marriage and raises questions about the significance of seemingly small acts in sustaining marital harmony.
