No Charges in Fatal Walmart Parking Dispute

North Lauderdale — A dispute over a parking space at a Broward County Walmart that ended in the fatal shooting of a retired Army staff sergeant will not result in criminal charges, prosecutors announced this week.

The Broward State Attorney’s Office stated that the September 3 decision to clear Melissa Payne in the June 30 shooting of 62-year-old Bart DiGuglielmo was mandated by Florida’s expansive self-defense statutes. Assistant State Attorney Stephen Zaccor explained that investigators could not disprove Payne’s claim of self-defense under the state’s stringent clear and convincing evidence standard.

The confrontation unfolded shortly before 12:30 p.m. at the West McNab Road supercenter. Payne was seated in a Chevrolet Malibu with her niece and an infant, while DiGuglielmo operated a Kia. Both motorists targeted the same vacant stall, triggering an argument that quickly escalated when both drivers exited their cars.

Surveillance footage recovered from a nearby Tesla and independent witnesses corroborated that DiGuglielmo approached Payne’s vehicle brandishing a key, gesturing toward her car, and threatening to cause property damage. Payne told responding deputies that she repeatedly warned him to halt and retreated before discharging a single round into his abdomen.

DiGuglielmo was rushed to Broward Health Medical Center, where he succumbed to his injuries. Payne immediately placed her firearm on her vehicle’s roof, remained on site, and cooperated with law enforcement.

While prosecutors acknowledged that video evidence did not definitively paint Payne as blameless in the initiation of the argument, the legal framework of the state’s Stand Your Ground law shields individuals from prosecution if they harbor a reasonable belief that deadly force is necessary to thwart death or great bodily harm, without imposing a duty to retreat.

The decision has intensified ongoing public scrutiny surrounding Florida’s self-defense framework, specifically regarding its application to volatile encounters stemming from minor, everyday grievances. Legal representatives for the DiGuglielmo family have voiced profound dissatisfaction with the outcome, arguing that the statute was never intended to protect individuals involved in fatal altercations originating over parking spaces.
