BASAURI, SPAIN — In a dramatic twist that has ignited a fierce national debate over Spain’s housing laws and migration policies, a prominent local progressive activist has been forced to abandon her own residence after a humanitarian gesture drastically backfired.

Estíbaliz Kortazar, a former local political candidate and activist from the Basque town of Basauri, finds herself locked out of her private property—not by corporate landlords or bureaucratic red tape, but by a North African migrant she took in out of pure solidarity.

A Noble Intentions Turned Nightmare

Kortazar, known for her staunch progressive and pro-migration advocacy, originally connected with the 48-year-old migrant through a local volunteer network. Seeking to practice the values she preached, she opened her doors and rented a room in her modest apartment to the man.

What began as an act of compassion quickly degraded into an atmosphere of intimidation. According to statements and petitions filed by Kortazar, the situation deteriorated rapidly once the tenant settled in. She alleges that the man subjected her to a relentless campaign of psychological abuse, including frequent sexual harassment, explicit verbal insults—including degrading terms like “puta” (whore) and “perra sucia” (dirty bitch)—and intentionally playing pornography in shared living areas.

When Kortazar demanded that he cease the behavior and leave, the situation escalated from hostile to untenable. The tenant allegedly stopped paying rent altogether, assumed de facto control over the apartment, and refused to vacate the premises.

Paralyzed by the Law

When a terrified Kortazar turned to local law enforcement for help, she was met with a harsh bureaucratic reality. Police officers informed her that because the man established residency inside the flat, they were legally powerless to intervene without a formal court-ordered eviction.

Under Spain’s stringent tenancy and anti-squatting (okupa) legal frameworks, homeowners attempting to forcefully remove an occupant—even one accused of harassment or non-payment—can face severe legal liabilities themselves. Left with virtually no legal recourse to reclaim her living space, Kortazar fled the apartment for her own safety.

She is currently staying with relatives and undergoing professional psychological treatment following a severe nervous breakdown.

A National Flashpoint

The staggering irony of Kortazar’s predicament has transformed her personal ordeal into a viral national symbol. Critics and political commentators across Europe have seized on the case, pointing to it as an extreme example of the friction between progressive ideological stances on open migration and the harsh realities of lax property protection laws.

Having launched a public change.org petition titled “Vivo CON mi okupa porque no le puedo echar” (“I live with my squatter because I can’t kick him out”), Kortazar is now demanding urgent legislative reform. She is calling on lawmakers to streamline and fast-track legal procedures, warning that current protections effectively strip ordinary citizens of control over their own homes.

As the petition gains traction across Spain, the case continues to fuel intense debate over whether the nation’s legal system is failing to protect citizens from abuses within their own private spaces.
