Kemi Badenoch Pressures Labour to Enforce 10-Year Residency Rule

​Conservative Party leader Kemi Badenoch has launched a renewed offensive against the Labour government’s immigration strategy, demanding that ministers hold firm on a proposed 10-year qualifying period for Indefinite Leave to Remain (ILR).

​In a letter addressed to the Home Secretary and shared on social media, Badenoch argued that temporary work visas should not serve as an automatic gateway to permanent settlement in the UK. The Conservative leader warned that any effort to water down the reform—specifically reports that the government might exempt the nearly two million migrants who arrived on work visas between 2021 and 2025—would be a “grave mistake.”

​The proposal to shift the standard settlement route from five years to a decade has become a flashpoint in UK parliamentary discourse. Supporters of the move, including Badenoch and the Shadow Home Secretary, Chris Philp, contend that the current five-year timeline is insufficient for demonstrating long-term commitment to the British economy.

​Badenoch stated that “people who come to Britain on temporary work visas should not automatically be able to stay forever.” Her policy prescription suggests that those failing to make a “significant economic contribution” within that 10-year window should be required to return to their home countries upon the expiration of their visas.

​The Conservatives have specifically sought to link settlement rights to the welfare system, arguing that shortening the path to ILR places undue pressure on social services and housing, as settled individuals become eligible for state benefits.

​While the Labour government had previously indicated support for extending the settlement period, internal pressure from some Labour backbenchers to protect recent arrivals from these changes has prompted the Conservative leadership to offer conditional cross-party support.

​Badenoch has signaled that the Conservative Party will back Labour’s original, more stringent proposals if they are introduced to Parliament in an “undiluted form.” By framing this as a litmus test for Labour’s commitment to border control, the Conservative leadership is positioning itself as the primary defender of a tougher, merit-based immigration framework.

​Under existing rules, most migrants on skilled worker or related routes can apply for settlement after five years of continuous, lawful residence. While a “10-Year Long Residence” route already exists for individuals who have built up time across various immigration categories, it is distinct from the primary work-based routes.
