Former Minneapolis police officer Derek Chauvin has filed a third petition for post-conviction relief in Hennepin County District Court, seeking to vacate his state murder conviction and dismiss the charges related to the 2020 death of George Floyd.
Filed by defense attorney Gregory J. Joseph, the new legal challenge argues that structural errors and constitutional violations occurred during the original proceedings. Specifically, the filing alleges that the initial prosecution authority was unlawful, pointing to how the case was assigned and arguing that a grand jury should have been convened prior to bringing charges.
Chauvin is currently serving a 22.5-year state sentence alongside a federal sentence for violating Floyd’s civil rights. This filing represents his latest attempt to overturn the conviction, following previous post-conviction motions dismissed by district courts.
