Wellesley Mother Fights Charges in Children’s Murders

​The legal defense team representing Janette MacAusland, a 49-year-old Wellesley mother accused of killing her two young children, pressed a Massachusetts court for a full case dismissal or immediate release during a heated hearing.

​MacAusland faces two counts of first-degree murder in the April deaths of her 7-year-old son, Kai, and 6-year-old daughter, Ella. Police discovered the children dead inside a bedroom of the family’s home after MacAusland arrived at her aunt’s residence in Bennington, Vermont, bearing neck injuries and allegedly confessing to a local officer that she had strangled them before attempting suicide.

​During proceedings at Dedham District Court, defense attorney Joseph Krowski argued that the state lacked sufficient evidence to hold his client behind bars, pointing out that prosecutors are still awaiting official medical examiner reports detailing the exact causes and manners of death. Prosecutors countered that the investigation remains active and defended her continued detention.

​The court appearance unfolded in the shadow of another high-profile Massachusetts tragedy—arriving just days after a mistrial was declared in the case of Lindsay Clancy, a Duxbury mother accused of killing her three children. While Krowski acknowledged public conversations surrounding mental health and criminal responsibility in the wake of the Clancy proceedings, he emphasized that MacAusland’s circumstances involve older children and a complex, bitter divorce and custody battle initiated by her husband, Samuel MacAusland, late last year. A court-appointed guardian had been assigned to the family’s custody dispute just days prior to the tragedy.

​The presiding judge rejected the defense’s motions, ordering that MacAusland remain held without bail pending further court dates.
