Argentina has filed a formal criminal complaint in federal court against several international energy companies, including Israel-based Navitas Petroleum and Canada’s JHI Associates, for drilling for oil and gas under British licenses near the Falkland Islands. President Javier Milei described the drilling as a “clear and urgent danger” to Argentine sovereignty, while the UK dismissed the legal threats as domestic politics.

A Legal Escalation Over a 190-Year-Old Dispute

Argentina on Monday announced a formal criminal complaint against several international energy companies for drilling for oil and gas under British licenses near the Falkland Islands .

The move marks a significant escalation in the long-standing sovereignty dispute over the British-controlled archipelago, which Buenos Aires calls Islas Malvinas.

Foreign Minister Pablo Quirno, backed by Treasury Attorney General Sebastian Amerio, filed the complaint in federal court against Israel-based Navitas Petroleum, Canada’s JHI Associates and Eco Atlantic Oil and Gas.

The government is also targeting individual directors, managers and shareholders, accusing them of carrying out unauthorized hydrocarbon, oil and natural gas exploration in the North Malvinas Basin .

Milei’s Warning: “A Clear and Urgent Danger”

The legal action comes just days after Argentine President Javier Milei warned that the Sea Lion oil project, an offshore drilling venture set to start production in the North Falkland Basin in 2028, poses an “imminent threat” to national resources.

In a primetime speech, Milei restated his government’s position on the territory, saying “the Malvinas are Argentine, historically and legally… there’s no debate about that”.

He argued that drilling in the archipelago constituted a “clear and urgent danger” to Argentine sovereignty.

Milei also dismissed the result of a 2013 referendum in which 99.8% of the islands’ residents voted in favour of the Falklands remaining a British overseas territory, arguing that they were living on land which had been “usurped” by the British and therefore “have no legitimate right to self-determination”.

The Companies and the Stakes

Navitas Petroleum, listed in Tel Aviv, holds a 65% stake in the Sea Lion project . The Sea Lion oilfield, located around 130 miles from the Falkland Islands, contains an estimated 1.7 billion barrels of oil.

Buenos Aires argues that Britain has illegally occupied the islands since 1833.

The simmering dispute has flared recently as offshore drilling projects move toward production .

As part of a broader defensive policy, Milei also signed a directive instructing Economy Minister Luis Andres Caputo to prioritize funding for an integrated naval base, a strategic military facility designed to support maritime security and territorial defense.

The British Response

The British government dismissed Milei’s speech and stressed that its position on the Falklands was “unwavering”.

London has dismissed the legal threats as domestic politics . Navitas has not yet responded to the latest statement but said last week that Milei’s remarks were “not expected to have a material effect on the development activities of the Sea Lion Project”.

Rockhopper, which owns a partial stake in the project, has also not yet commented .Both companies have in the past stressed that Sea Lion holds valid licenses from the Falkland Islands .

A Lesson for Nigeria

The Argentine-UK dispute over the Falklands is a reminder that sovereignty disputes do not fade with time. After nearly 200 years, Argentina continues to assert its claim to the islands through diplomatic and now legal means.

The same nations that dismiss Argentina’s claims as “domestic politics” will never allow their own territories to be challenged.

Their sovereignty is protected.

For Nigeria, the lesson is clear: territorial integrity must be defended through all lawful means. Whether it is the Falklands, Western Sahara, or any other disputed territory, nations must be willing to assert their sovereignty through diplomacy, international law, and, when necessary, legal action.

Argentina’s decision to file a criminal complaint against foreign companies is a bold move that could set a precedent for other nations with unresolved territorial disputes.

Defend your sovereignty. Use every legal avenue. And never forget that a nation that does not assert its rights will eventually lose them.
