British Teen Jailed in Dubai Pleads for Clemency

Dubai, UAE – A British teenager, Marcus Fakana, 19, who was jailed in Dubai for having consensual sex with a 17-year-old British girl, has appealed to Sheikh Mohammed bin Rashid Al Maktoum, the ruler of Dubai, for clemency. Fakana, from Tottenham, North London, was sentenced to one year in prison in December after a relationship that was legal in the UK but considered illegal in the UAE, where the age of consent is 18.

Fakana, who was 18 at the time of the incident, handed himself in to authorities in December to begin his sentence at Al Awir Prison. The consensual relationship came to light when the girl’s mother reported Fakana to UAE authorities after discovering messages between the two upon their return to the UK.

Radha Stirling, founder of the advocacy group Detained in Dubai, which is supporting Fakana’s family, described the experience as “the most traumatic and life-altering imaginable for Marcus.” She emphasized that Fakana “never intended to break any law” and that the isolation in prison has been mentally and emotionally devastating for him and his family.

Fakana’s parents have been actively appealing to Foreign Secretary David Lammy, the Foreign, Commonwealth and Development Office (FCDO), and the British Embassy in Dubai for assistance in securing his release. Ms. Stirling stated that Fakana “has shown remorse and fully respects the laws of the UAE,” hoping the government will show compassion.

This case highlights the significant differences in legal systems and the importance for individuals, particularly teenagers, to be aware of local laws when traveling abroad. Detained in Dubai has consistently warned that actions not considered criminal in one’s home country, such as consensual relationships, social media activity, or alcohol consumption, can lead to serious charges in the UAE.

A spokesperson for the Dubai government previously stated that “Under UAE law, the girl is legally classified as a minor and, in accordance with procedures recognised internationally, her mother – being the legal guardian – filed the complaint.” They affirmed Dubai’s legal system is “committed to protecting the rights of all individuals and ensuring impartial judicial proceedings.”

An FCDO spokesperson confirmed they are “supporting a British man in the UAE and are in contact with his family.”

Fakana’s plea for clemency is a desperate bid to return home and rebuild his life, as his supporters implore Sheikh Mohammed and the government of Dubai to grant him a humanitarian pardon.
