The Ministry stated that the demolition aligns with the Federal Ministry of Works’ regulations regarding the Right of Way on federal roads and bridges nationwide.

Professor Dahud Kehinde Shangodoyin, representing the Ministry, explained that the Ojoo-Akinyele Interchange falls within this Right of Way, which extends 45.72 meters from either side of a federal road or bridge’s centerline, as stipulated in the Federal Highway Act, Cap 135.
The Ministry emphasized that the Oyo State Government sought and obtained approval from the Federal Government to reconstruct the Ojoo-Akinyele Interchange. However, ownership of the road and adherence to Right of Way regulations remain under the Federal Government’s purview.
The statement reiterated that all parties, including the Oyo State Government and the public, must comply with Federal Government regulations, including the prohibition of construction within the Right of Way. The demolition of illegal structures was therefore carried out in accordance with these established rules.
The Ministry’s statement referenced a public notice issued by the Federal Ministry of Works on March 13, 2020, cautioning against the development of illegal structures within the Right of Way of federal roads. It clarified that any construction within the Federal Road Right of Way requires the explicit approval of the Minister of Works, who oversees the management and control of federal highways across Nigeria.
